These AI Terms of Use (the "AI Terms"), together with Our general Terms of Use, govern the terms and conditions under which you may use any of Our products featuring integrated AI functionalities. Please read these AI Terms and the general Terms of Use carefully to ensure you understand your obligations. Your agreement to be bound by these Terms is effective upon your first interaction with Our AI-enabled products. If you do not agree to comply with these terms, you must immediately cease using productiveminds.com and all associated products.

Age Requirement

Consistent with our general terms, our website and all AI products are intended for use only by individuals who are 18 years of age or older.

AI Providers - Third Parties

All AI functionalities within Our products function as tools. These tools transmit your requests and the provider's responses based on the specific agreement between you and the third-party AI provider, authenticated via your unique API key.

Users of our AI products must first obtain a personal API key directly from an AI provider by agreeing to that provider's specific terms of service. Your individual agreement with the provider constitutes the legal basis upon which our products operate. This allows your WordPress site to communicate with the provider's endpoints, utilizing your own API key for authentication and identification.

  • We are not an AI provider.
  • We are not affiliated with any AI provider.
  • We do not endorse any AI company.
  • We are not endorsed by any AI company.
  • We do not have partnerships with any AI provider.
  • We do not represent any AI provider.

Our products are integrated into WordPress as plugins or themes, enabling your WordPress site to interact with AI providers through publicly available endpoints. There are no special arrangements, exclusive agreements, or additional refinements between our products and these service providers.

Awareness of the Nature of AI Interactions

Our products are not a mechanism for influencing core AI operations. Based on the inherent limitations and potential complications disclosed by AI providers in their respective agreements, please be aware of the following limitations, risks, and undesirable outcomes associated with using AI:

  • The AI may disregard your input and generate unrequested output.
  • The AI may produce unwanted or inappropriate responses.
  • AI responses may be inconsistent, degrading, or otherwise unreliable.
  • Responses from an AI may be unusable or unfit for a specific purpose.
  • UI controls and options provided in Our products are transmitted to the AI provider; however, we do not guarantee that a specific configuration or prompt will yield a desirable response.

Processing of Your Data and Personal Data

Personal data provided by you when purchasing our products is governed by our general Terms of Use and Privacy Policy. We maintain no visibility into, nor do we have access to, any data generated by an AI provider during the use of Our products. Accordingly, we do not process any data generated by AI, including data generated through the use of Our AI-enabled products.

Our Products Are:

  • Tools. They transmit your requests to required endpoints and return responses from the model as required.
  • Local to your infrastructure. All responses, usage data, and configurations are stored locally on your own infrastructure.
  • Direct communication channels. Communications between you and the provider's endpoints are direct; there is no re-routing or intermediary connecting services involved in Our products.

Our Products Are Not:

  • Remote processing systems. We have no visibility into your generation activities or the data received from the AI provider.
  • Fault-proof against AI errors. We do not offer corrections for potential errors generated by the AI.
  • Guaranteed to be compliant with every specific AI model. Our products may occasionally lack a specific feature desired by you.
  • Involved in AI generation. Our products have no involvement or control over the actual generation of AI responses.
  • Processed by our servers. Your data is not seen or processed by our servers.
  • Saved remotely on our servers. Your data is not stored on our remote servers.
  • Guaranteed to produce results. Our products do not include any guarantee or promise that the AI will successfully respond to your specific request.

Smart Prompt Optimization

When generating images and videos, optional directives are provided from which you may choose to include in the prompt sent to the Large Language Model (LLM). When one of these options is selected for a compatible model, the overall style of the generated asset may be influenced by that selection. The following options are available:

  • Hyper-Realistic Photography.
  • Cinematic Movie Still.
  • Vintage Film.
  • Digital Painting.
  • 3D Pixar/Octane Render.
  • Minimalist Vector Art.
  • Anime / Manga.
  • Watercolor Illustration.

Local AI Laws - Adherence and Compliance

Our AI products are released without regard for specific local restrictions or limitations of usage regarding your local laws and regulations. Certain jurisdictions may be governed by laws that prohibit the types of AI usage provided in our products. You agree to verify and ensure compliance with all laws governing your own use of AI; you are responsible for monitoring any legislative changes affecting the services provided by our products. Our products offer the capabilities of AI without a guarantee that such capabilities are permitted or supported in your specific location. It is your sole responsibility to ensure your use of the products complies with local regulations. By using our products, you agree that your usage shall comply with all applicable laws governing such usage.

Costs

Aside from the initial cost of acquiring Our products, no additional costs are charged for AI usage. Your costs for AI usage are determined solely by the AI provider; Our products have no direct involvement in determining your usage costs with those providers.

Free Tiers

When a service is labeled as "FREE TIER," this reflects the documentation provided by the AI provider during the most recent release of that product. This does not guarantee that the FREE TIER will be available at the time of your request, nor does it guarantee that the free entitlement applies to your specific account or geographic location. You are responsible for verifying service availability and associated costs directly with the provider.

The Limit of Our Technical Support

Technical support for our AI products is limited to the functionality of the product itself. Because Our products do not participate in the internal AI generation process, we do not have visibility into issues arising within the AI's own processing. However, we are happy to receive support requests and will advise you whether an issue falls within the scope of our features. If you experience a problem while using our product, you are welcome to open a support ticket; however, if the issue is specific to the AI generation process itself, you are advised to contact the AI provider's customer support.

Intellectual Property and Responsibilities

Your API keys are your sole responsibility. Our services do not provide any additional benefits or modifications to the services offered by the AI provider via your API keys.

The reliability, fitness for purpose, and expected performance of AI-generated content are governed solely by the terms between you and the AI provider as the owner of the API key. You must agree to and understand these terms regarding expectations and satisfaction derived from the service. Our plugin usage does not alter or modify the responses provided by the AI.

Warranties, Liability and Disclaimers

Nothing contained in Our AI products constitutes professional advice upon which you should rely. The information is provided for informational purposes only. You should always seek professional or specialist advice before taking any action based on information provided within Our AI products.

To the fullest extent permitted by applicable law, we make no representations, warranties, or guarantees that Our AI products will meet your specific requirements, that they will not infringe the rights of third parties, that they will be compatible with all users' software and hardware, or that they will be secure.

While we make reasonable efforts to ensure that Our AI products are complete, accurate, and up-to-date, we do not make any representations, warranties, or guarantees (whether express or implied) regarding the completeness, accuracy, or timeliness of Our AI products for any user's particular system, situation, or environment.

To the fullest extent permitted by law, we accept no liability to any user for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) Our AI products, or the use of or reliance upon any Content (whether that Content is provided by Us or contained in Guest Posts or Comments created by Users) included in Our AI products.

To the fullest extent permitted by law, we exclude all representations, warranties, and guarantees (whether express or implied) that may apply to Our AI products or Content.

We provide Services for use by our Users. We make no warranty or representation that Our AI products are fit for reselling purposes. We will not be liable to you for any loss of profit, loss of business, interruption to business, or any loss of business opportunity.

We are not responsible for the content or accuracy, nor for any opinions, views, or values expressed by any AI providers or other third parties. Any such opinions, views, or values belong solely to the relevant User and do not reflect Our opinions, views, or values in any way.

We exercise all reasonable skill and care to ensure that Our AI products are free from viruses and other malware; however, we accept no liability for any loss or damage resulting from a virus, distributed denial of service (DDoS) attack, or other harmful material or events that may adversely affect your hardware, software, data, or other materials resulting from your use of Our AI products.

Release and Indemnity

You, as the Customer, shall indemnify, defend, and hold harmless ProductiveMinds Publishing and Learning Ltd, its directors, employees, and partners against any and all liabilities, losses, expenses, costs (including legal fees), and damages (including, but not limited to, any direct, indirect, or consequential loss, loss of profit, or damage to reputation) suffered by, incurred by, or awarded against ProductiveMinds Publishing and Learning Ltd arising out of or in connection with: (i) The Customer’s breach, non-performance, or negligent performance of The Customer’s obligations under this Agreement; or (ii) any claim made against ProductiveMinds Publishing and Learning Ltd by a third party arising out of or in connection with The Customer’s use of our services, data, hardware, software, and any associated infrastructures, facilities, tools, and communications.

Delivery

Your ordered product(s) will be available to download the same day. Usually your download link will be provided in the Order confirmation email few minutes after completing your order. If you placed order(s) before registering an account on Our Site, your earlier order(s) will be automatically linked to your account when you register and login with the same email address as your order(s).

Refund

We are dedicated to ensuring our customers' satisfaction. We adhere to established methodologies and best practices to guarantee quality, ensuring the reliability and maintainability of our solution. However, we acknowledge that not all systems are identical. Therefore, if our product or service does not perform as described or if you encounter any issues rendering it unusable, kindly follow the "refund procedure" instructions provided below within 14 days of your purchase to request a refund.

Refund Eligibility Criteria

Please note that we may not issue refund in the following situations:

  1. The user change their mind about the purchase.
  2. The purchase was for a renewal of license. We can only refund the initial purchase, we do not refund renewals.
  3. Where there has not been contact with Us, as described in the refund procedure section above.

Blog, Guest Posts, and Comments

An Account is required if you wish to submit a Guest Posts or Comment on Our Blog.

You agree that you will be solely responsible for your Guest Posts and for any Comments you make anywhere on Our Site. Specifically, you agree, represent and warrant that you have the right to use the content that you submit and that your Guest Posts, or Comments comply with Our Acceptable Usage Policy, detailed below.
